The Punjab and Haryana High Court has stayed a demolition order issued by the Municipal Corporation of Manesar (MCM) against a Ready Mix Concrete (RMC) plant owned by UltraTech Cement Limited. The plant is located in Naurangpur village, Gurugram district.
The Case

The Order: On January 9, the MCM issued an order directing UltraTech to stop operations immediately and demolish the plant within seven days. The civic body threatened to seal or demolish the unit and recover costs as “arrears of land revenue” if the order was not followed.

The Stay: Justice Harsh Bunger ordered that the execution of the demolition order be kept in abeyance until the next hearing, scheduled for February 25, 2026.

Petitioner’s Stand: UltraTech Cement, represented by senior advocate Anand Chhibbar, termed the MCM’s order “wholly arbitrary, unreasonable, and illegal.”

Approvals: The company argued that the plant has been operating legally for decades (previously under Grasim Industries) with all necessary approvals, including Change of Land Use (CLU) permissions from 1998 and a valid Consent to Operate from the Haryana State Pollution Control Board (valid until August 2024).

CLU Issue: The MCM allegedly based its order on the incorrect assumption that the CLU was for a “factory” and not an RMC plant. UltraTech countered that the CLU documents clearly identify the unit as “Vikram Premium RMC.”

Procedural Lapse: The petitioner also argued a violation of natural justice, stating that the MCM ignored their detailed replies and documents submitted in July and August 2025, issuing the demolition order six months later without explanation.
