Shamlat Land Relief: Occupants Can Own Land by Paying 1.5x Collector Rate

In a landmark policy shift aimed at resolving decades-old property disputes in rural areas, the Haryana Government announced a major decision on July 15, 2025, allowing illegal occupants of ‘Shamlat Deh’ (village common land) to regularize their possession. The government has cleared a path for these occupants to gain legal ownership rights by paying a penalty fee fixed at one and a half times the collector rate.

The decision, which comes as a relief to thousands of families living in rural Haryana, applies specifically to those who have constructed houses on Shamlat land on or before the cutoff date of March 31, 2004.

Key provisions of the new policy include:

  • Rate of Payment: Eligible occupants can transfer the land title to their name by paying 1.5 times the prevailing collector rate of the area.

  • Area Limit: The regularization is capped at a maximum area of 500 square yards per beneficiary.

  • Open Space Rule: The policy stipulates that the open space within the plot must not exceed 25% of the constructed area.

The move is designed to settle thousands of pending legal cases where villagers have been living on common Panchayat land for generations without legal title. By regularizing these plots, the government aims to provide security of tenure to residents while simultaneously generating revenue for the Gram Panchayats, which will receive the funds collected from these transfers.

Officials clarified that this policy applies only to residential constructions and does not cover commercial encroachments or land reserved for essential common purposes like ponds, paths (rasta), or schools. The Department of Development and Panchayats has been tasked with creating a simplified application process to expedite these transfers.
